Constructive Res Judicata

Explanation IV-

When any matter which might or to have been a ground of Defence by the defendant or Attack by the plaintiff in former proceeding but was not to made, then such a matter will be Deemed to have been constructively in issue and therefore is taken as decided and such matter cannot be used in any subsequent proceeding this is known as constructive res judicata.
