Criminal Conspiracy ( Section-120-A)
- It is substantive offence.
- It is actionable per se.
- Sanction of competent authority is necessary to proceed against the conspirator.
- Agreement between two or more persons to commit an offence is enough to commit criminal conspiracy.
- Punishment under section 120-B.
Abetment by Conspiracy { Section- 107(2) }
- It is not substantive offence.
- It is not actionable per se.
- No sanction is required.
- Agreement between two or more person to do some act or illegal omission is not enough, there shall be some act or illegal omission in pursuance of that agreement.
- Punishment u/s 109-120.
